Operating Agreement
1. INTRODUCTION.
The HRRVC.net
Network is an e-mail service of the Holiday Clickers
Chapter #452, an authorized chapter of the Holiday Ramblers Recreational
Vehicle Club, Inc. (HRRVC). This Agreement explains its obligation
to you, your obligation to it, in relation to the use of the
HRRVC.net
service herein identified as The HRRVC.net Network.
2. AMENDMENT.
HRRVC.net
Network may modify this agreement at any time in its sole
discretion. Modifications may be sent by e-mail message, or conventional
mail.
3. USE of SERVICE.
You may only use the HRRVC.net Network service as a
Holiday Clickers member. HRRVC.net Network may immediately,
at its sole discretion, terminate service to delinquent users.
4. CHARGES.
You are responsible for all published fees and charges, if
any, associated with the use of the HRRVC.net Network service.
5. TERMINATION.
This agreement became effective September 1, 2005, and remains
in effect until terminated by either you, or HRRVC.net Network pursuant to this
agreement. Each may terminate this agreement at any time without
notice for any reason or no reason at all.
6. LIMITATION OF LIABILITY.
Under no circumstances, including negligence, will HRRVC.net
Network, or any affiliated company or person, be liable
to you for any direct, indirect, incidental, special or consequential
damages that result from your use or inability to use the HRRVC.net
Network service, including but not limited to reliance
on any information provided by HRRVC.net Network; or that result
from mistakes, ommissions, interruptions, deletion of files or
e-mail, loss of or damage to data, errors, defects, viruses,
spam or junk mail, delays in operation or transmission, or any
failure of performance, whether or not limited to acts of God,
communications failure, theft, destruction or unauthorized access
to HRRVC.net
Network's records, programs or services. The terms
of this Section shall survive any termination of this agreement.
7. RIGHT OF REFUSAL.
Although you have the right to request a "destination e-mail
address", HRRVC.net Network reserves the
right to refuse your selection and you agree that such refusal
is not a basis for liability or damages to you
8. SEVERABILITY.
You agree that the terms of this agreement are severable. If
any term or provision is declared unenforcable, that term of
provision will be construed consistant with applicable law as
nearly as possible to reflect the original intent between us,
and the remaining terms and provisions remain in full force and
effect.
9. FORWARDING SERVICE.
The RVmail.net
Network may provide you with the ability to foward your
e-mail address at HRRVC.net Network to another e-mail
adress of your choosing, providing you represent to us that you
have the right to use the other e-mail address.
10. ACCEPTABLE USE.
The HRRVC.net
Network is a family type service meeting community standards
norm.
11. NOTICES.
Any notices given you in connection with this agreement will
be sent to the HRRVC.net Network e-mail address
you selected and is in force at the time of the notice, otherwise
to the last postal address given to us at the time you entered
our network. Notice to us shall be to 17769@hrrvc.net, otherwise
by mail to The HRRVC.net Network, 4050 N. Maiden
Drive, Baton Rouge, Louisiana 70809.
12. FAILURE TO PERFORM.
HRRVC.net
Network has obtained, leased, rented, or purchased,
Internet server capacity in the open market and will not be liable
for failure to perform any obligation under this agreement, including,
but not limited by, failure caused by the occurrence of any unforseen
contingency beyond the reasonable control of HRRVC.net Network and/or its
"server" including without limitation outages, communications
outages, fire, flood, war, or act of God whether to the HRRVC.net
Network facility or the "server" facility.
13. GENERAL TERMS. Interpretation and enforcement
of this agreement will be governed by the laws of the state of
Louisiana.
